NASHUA – Jealousy coupled with misdiagnosed and untreated schizophrenia prompted Brandon Nye to charge up the stairs in his former girlfriend’s home and stab her boyfriend, Brandon Gaudette, eight times in the chest, according to statements in Hillsborough County Superior Court on Friday morning.
Nye was 19 on Aug. 23, 2010, when he killed Gaudette, 21.
On Friday, a quiet, polite Nye accepted responsibility and expressed remorse as he pleaded guilty to second-degree murder.
Under an agreement reached between Nye’s public defender attorneys and prosecutors, Nye was sentenced to state prison for 35 years to life.
The sentence is “at the high end” of the range for second-degree murder, said Assistant Attorney General Jeffrey Strelzin.
He said the sentence was appropriate because the attack was unprovoked and the victim unarmed. There also was evidence that the murder was premeditated because Nye had returned to the 74 Ridge Road home of his former girlfriend, Erin Allwood, then 16, where he had been earlier that day, Strelzin said.
Also, Nye had previously threatened to kill Allwood’s new boyfriend, Strelzin said.
Allwood had broken up with Nye after they had dated for two years, according to court statements.
“He was angry that she had broken up with him and she had a new boyfriend,” Strelzin told reporters outside the courtroom after the sentencing hearing.
During court proceedings, Strelzin said Nye had texted Allwood asking if he could talk to her.
